High Court dismisses Gemma O’Doherty and John Waters case

A Judge said ''they have no medical or scientific qualifications or expertise''.

A High Court judge has decided Gemma O’Doherty and John Waters haven’t made an “arguable case” to allow them challenge the Covid-19 restrictions.

They claimed the introduction of the measures by way of emergency legislation last month was a disproportionate response to the crisis.

The pair sought a judicial review in the hope of having the emergency legislation declared “null and void” on the grounds of what they claimed was its repugnancy to the Irish constitution.

They used words like “draconian, regressive and unnecessary” to describe the measures introduced.

The judge agreed they had standing to bring such a review in relation to some areas, but he felt they didn’t in others, and in dismissing their application, he decided they hadn’t raised an “arguable case”

Mr. J Charles Meenan said:

“They have no medical or scientific qualifications or expertise, and have relied upon their own unsubstantiated views, gave speeches, engaged in empty rhetoric and sought to draw an historical parallel with Nazi Germany – a parallel which is both absurd and offensive.”

The issue of costs will be dealt with at a later date.
