Aldi says its Cuthbert the Caterpillar cake is 'now free' after settling its copyright dispute with Marks and Spencer.
M&S launched a lawsuit last April, claiming the German company copied its version, called Colin.
Although Colin is referred to on the M&S website as ‘the original and the best’ – he’s not the only chocolate caterpillar on the market, with similar cakes being sold in other stores including Sainsburys.

Both supermarkets have confirmed an agreement's since been struck - but say they can't release details of what they're calling a 'confidential' deal.
But Aldi have been pretty good sports about the whole thing.
Getting out early on good behaviour, keep an eye out for Cuthy B this Spring ?? x #FreeCuthbert
